The terms “we”, “us”, “our” and “SPL” refer to Shropshire Publishing Limited.

The term “advertiser” means the person or body forming a contractual agreement by submitting an advertisement for any publication produced by Shropshire Publishing Limited. In order for SPL to provide the very best service, advertisers need to be aware of our Conditions for Acceptance of Advertisements. The following conditions govern our acceptance of all advertisements for publication in our title and the placing of an advertisement by any advertiser is deemed to be an acceptance of these conditions.

1. SPL reserves the right to refuse any application for an advertisement- without explanation. Our agreement to publish any advertisement is conditional upon our seeing the proposed advertisement. We reserve the right to refuse or revise part or all of the advertiser’s artwork or copy at our sole discretion. The decision of SPL is final.

2. An advertisement must comply with the requirements of all relevant legislation and codes of practice governing the advertising and newspaper industries in force in the United Kingdom at the time of placing the advertisement. All advertisements submitted must be legal, decent, honest and truthful.

3.Any advertisement that are subsequently deemed not to meet our Conditions of Acceptance will be withdrawn from future issues.

4. It is the responsibility of the advertiser to check the advertisement and notify us of any mistake or inaccuracy immediately it appears. We will make all reasonable efforts to ensure accuracy at all times. We reserve the right to make reasonable changes to the size of advertisements as they appear on publication, and to avoid doubt we make no guarantee that an advertisement will appear exactly in accordance with any size specifications given. Additionally all advertisements purported to be ‘full-page’, ‘half-page’ or quarter-page shall be sized at our discretion.

5.Colour registration will conform to current print specifications. In the event of an error in the colour reproduction or in printing of an advertisement which materially detracts from it we will re-insert the advertisement or the relevant parts of the advertisement to rectify the error- and our liability for such errors (including colour blurring) is limited to such re-insertion.

SLP will not be liable for any consequential or immediate loss resulting from any error in an advertisement,- (whether in the content, layout or printing) or from omission of an advertiisement.

6.Our liability for any error, misprint or omission will not exceed the lesser of either:-

(a) the amount of a full refund of the sum paid to us for the advertisement or the first of a series of advertisements; or

(b) the cost of a further corrected advertisement of a type and standard reasonably comparable to the original advertisement (i.e. SLP would reprint the advertisement in a ‘future’ edition where available).

7.We will not be liable for any loss of copy, artwork, photographs or other materials, or for any loss or damage consequential thereto. Advertisers providing such materials are advised to retain adequate copies for their use in the event of such loss.

8.Box Numbers are only available to private advertisers and some Situations Vacant advertisement. Applications for Box Numbers must be made in writing and include evidence of address that is less than 3 months old (utility bill; council tax bill, bank or building society statement – or similar document). SLP does not accept liability for any loss of any kind arising from the non-receipt or delay in the receipt of replies to Box Numbers. We also do not accept liability for any disclosure of the identity of the advertiser to any third party. The advertiser hereby authorises SLP to disclose to Trading Standards, the Police or other competent authority any information relating to the advertisement or the advertiser. Any such disclosure will be made by us in good faith, and the advertiser acknowledges that he will have no cause of action in respect of any such disclosure. SLP reserves the right to withdraw the Box Number service immediately and without prior notice and for any reason, including the breach of any of these conditions or where we believe the reputation of SLP could be brought into disrepute.

9.All advertising, (including trade and private advertising) must be prepaid. Funds must be cleared before publication.

10.Advertisements (including text, images and logos) are accepted in good faith by SPL in the belief that advertisers are not infringing any copyright or other intellectual property rights. The advertiser warrants to us that the reproduction and/or the publication of any advertisement does not breach any contract, or infringe or violate any copyright, trademark, or any other personal or proprietary rights.

11.The advertiser agrees that copyright and any other intellectual property rights in advertisements, and advertisements created by SPL shall be vested in us and be our sole property and we alone shall have the right to instigate proceedings and to claim damages and all other relief in respect of infringements of such copyright and intellectual property rights.

Data Protection.

The advertiser agrees to the reasonable processing of any personal data relating to the advertiser within the meaning given by the General Data Protection Regulation (GDPR) for the purposes of providing advertisement insertion services to the advertiser. Processing of any Personal Data by us will comply with all relevant legislation, including but not limited to the Data Protection Act, and any relevant Codes of Practice. SPL is compliant under the General Data Protection Regulation (GDPR) 2018.
These conditions shall be interpreted in accordance with and governed by the law of England and Wales.
